Mr. Wiseley stated that the Board could consider the case based on the merits of the application but that generally the Board gave the applicant another opportunity to appear.
Ms. Mathewson asked if that would need action from the Board.
Mr. Wiseley stated that they could vote on a formal continuance.
Ms. Fritch made a motion to continue BZA 05-26 the appeal filed by Game of Homes, LLC to the March 26, 2026 regular monthly meeting. Ms. Knapp seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None. Motion carried, BZA 05-26 automatically continued to March 26, 2026.
Being a public hearing on the matter of an application filed by Raychelle Johnson, requesting a variance of use from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow a commissary for a food truck, to allow a commercial store with a commercial kitchen in a pole barn, and to allow a 4’x8’ sign to advertise the business, on premises located at 11700 North Old Granville Road, Albany, Indiana, as more accurately described in the application.
Raychelle Johnson, 11700 North Old Granville Road, Albany, Indiana, appeared. She stated that they had a small farm stand with pumpkins, corn, and other garden vegetables. She stated that they had an area in their pole barn that would be ideal to have more items for people to come get produce, seasonal décor, maybe freezer meat, eggs, and even syrup from the property. She stated that they also had a food truck and needed the area for a designated commissary and commercial kitchen. She stated that they may install a sign sometime in the future as well.
Ms. Mathewson asked if the store would mainly operate during the summer months.
Ms. Johnson stated that it would be the busiest in the summer and fall but would be open year-round.
Ms. Mathewson asked if they anticipated more that the 2 employees and if the hours would be only as listed form 10:00 AM to 7:00 PM.
Ms. Johnson stated that those hours would be for the busier months and that they would not be open later and that right now it was just her and her husband and that right now they would not have any other employees.
Ms. Mathewson asked if the food truck would only be stored at this location and not be operating from there.
