Ms. Vannice stated that they tried to reduce the number of trees that would cause a line of sight concerns and possibly cause an accident if someone could not see the lights on the trucks.
Ms. Fritch asked if the health of the existing trees had been assessed to determine how long they might be on the property.
Ms. Vannice stated yes, they had walked the parcel and that the 2 large trees were in good condition and that a few shrubs were being removed for visibility.
No one appeared in opposition.
Mr. Ivy asked if he needed to recuse himself from the vote since he was the original project manager for the development.
Mr. Wiseley stated that generally speaking you would be required to if you had a financial interest in the project or were unable to be impartial.
Ms. Swackhamer stated that Mr. Rawlings had no concerns about the request.
Mr. Hamilton made a motion to approve BZA 22-26 the application filed by Indiana University Health Ball Memorial Hospital with the hardship as stated in the application. Mr. Hinds seconded the motion. Voting in favor: Mr. Billington, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: Ms. Fritch. Motion carried, BZA 22-26 approved (6-1)

Being a public hearing on the matter of an application filed by Rentovation LLC, requesting a variance from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow reduced side setbacks for existing duplexes to be separated through platting. An additional request from the terms of the Delaware County Subdivision Ordinance is to allow a minor plat, rather than a major plat, to create 8 lots on premises located at 509-615 North Northwood Drive, Liberty Township, Delaware County, as more accurately described in the application.
Kathy Vannice, Ashton Land Surveyor, appeared to represent the applicant. She stated that the properties had been rezoned and then it was discovered that several setbacks would not meet current standards.
No one appeared in opposition.
Ms. Fritch made a motion to approve BZA 24-26 the appeal filed by Rentovation LLC with the hardship as stated in the application with the condition that the platting process be completed and recorded. Mr. Hinds seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None.
