Jurisdiction: Board of Zoning Appeals

Being a public hearing on the matter of an application filed by Britany Mauck and Maucky’s, requesting a variance of use from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow a commissary and commercial kitchen in an existing garage in a farm zone on premises located at 16670 North County Road 600 West, Washington Township, Delaware County, Indiana, as more accurately described in the application.

Britany Mauck, 16670 N. CR 600W., Gaston, Indiana, appeared. She stated that she was asking for the change from farming to business to allow her food truck. She stated that they had been using her in-laws for their commissary but had built a new pole barn to have it on their property.

Ms. Mathewson asked if she had talked to any of the neighbors and if they were favorable.

Ms. Mauck stated they were supportive and that it helped when you had good food.

Ms. Mathewson stated that they would still need to go through the permitting process.

Ms. Mauck stated that she had plan reviews in with the Building Commissioner and Health Department.

Ms. Swackhamer stated that Mr. Fouch had been in contact with Ms. Mauck and she was working on her required permits.

Commissioner Brand appeared to speak in support of Ms. Mauck and stated that she supported many community events including the County fair and that he would ask the Board for their approval.

No one appeared in opposition

Ms. Fritch made a motion to approve BZA 25-26 the appeal filed by Britany Mauck with the hardship as stated in the application with the following conditions; 1) That the variance is for the applicant only and will not transfer with the property and; 2) That the applicant will obtain all applicable permits, including Building Commissioner and Health department approvals. Ms. Knapp seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None. Motion carried, BZA 25-26 approved (7-0).

Being a public hearing on the matter of an application filed by Joshua and Lisa Johnson, requesting a variance of use from the terms of the Delaware County Comprehensive Zoning Ordinance, to allow a diesel and auto repair shop to operate in an existing garage, located in a single-family residence zone, on premises located at 12701 East Jackson Street, Liberty Township, Delaware County, Indiana, as more accurately described in the application.

Lisa Johnson, 12701 E. Jackson St., appeared. She stated that they would like permission to continue to operate their auto repair from their home. She stated that they had moved from Redkey where there were no restrictions and did not know that this was not allowed. She stated that they had a large family and that this was how they earned an income. She stated that it was operated in an existing building
