Ms. Mathewson stated that the Board would need to have discussion on the current motion on the floor.
Mr. Hinds stated that the applicant could still come back in the future and ask for a permanent change in zoning.
Ms. Swackhamer stated yes, that would be an application for rezoning. She stated that there were previous variances for the Senior Center now and that the variances were needed due to the expansion. She asked Mr. Wiseley if there was no condition would the variance of use continue with the property.
Mr. Wiseley stated that a variance of use transfers with the property unless otherwise specified.
Ms. Mathewson asked if the motion could be amended or if they could vote as stated.
Mr. Wiseley stated that it would need to be withdrawn to be amended.
Ms. Fritch stated that she did not wish to withdraw her motion.
Ms. Swackhamer asked for clarification, if this motion was voted on, could a different motion be made after.
Mr. Wiseley stated that once official action on a motion was taken, it would dispose of the case.
Ms. Fritch made a motion to approve BZA 16-26 an appeal filed by The Muncie-Delaware County Area Senior Citizens Council, Inc. and DCRT, LLC with the hardship as stated in the application with the condition that the variance shall be for the applicant only and will not transfer with the property. Mr. Ivy seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None. Jurisdiction: Board of Zoning Appeals
Being a public hearing on the matter of an application filed by Indiana University Health Ball Memorial Hospital, requesting variances from the terms of the City of Muncie Comprehensive Zoning Ordinance, to allow a reduced sidewalk along Jackson Street and no sidewalk along Brittain Avenue, and to allow no marked pedestrian crosswalk. Additionally, requests to allow an increased build-to line, and to allow a reduction of shade and ornamental trees for the west side and rear of the property, and to allow reduced buffer plantings along the rear of the lot., on premises located at 2315, 2321, and 2325 West Jackson Street, Muncie, Indiana, as more accurately described in the application.
Kathy Vannice, Ashton Land Surveyor, appeared to represent the applicant. She stated that the request was for a new fire station to be placed and that the building needed to be further back to accommodate the trucks. She stated that they were also asking for no sidewalk since this would not have public access. She stated that they tried to be as much in compliance as they could while making it safe for everyone.
Ms. Fritch asked about the reduction in plantings along Jackson Street.
