Lloyd Murphy, 11919 E. Jackson St., Parker City, appeared in support. He stated that he was the adjacent neighbor and was also down wind from the property. He stated that everything was in good condition, the vehicles all ran, and that the animals were well kept and the property well maintained. He stated that he had no issues and was in support.

Rosalie Patton, 12221 E. Jackson St., appeared. She stated that she lived on the other side of Ms. Guise and that until a few years ago she owned cattle and had no idea that she was in a residential neighborhood. She stated that she owned 45 acres and had no idea, and she would like to see the entire neighborhood agricultural. She stated that she was in support of the request.

No one appeared in opposition.

Ms. Fritch made a motion to approve BZA 28-26 the appeal filed by Cheryl Guise with the hardship as stated in the application with the condition that the variance be for the applicant only and not transfer with the property. Mr. Ivy seconded the motion. Voting in favor: Mr. Billington, Ms. Fritch, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: None. Motion carried, BZA 28-26 approved (7-0).

Jurisdiction: Board of Zoning Appeals

Being a public hearing on the matter of an application filed by The Housing Authority of the City of Muncie, Indiana, requesting variances from the terms of the City of Muncie Comprehensive Zoning Ordinance, to allow a storage site for the Muncie Housing Authority of the City of Muncie and to allow reduced landscaping in the rear and side buffer yards, all for a new storage unit in a business zone, on premises located on the 1500 block at the northeast corner of Madison Street and 9th Street, Muncie, Indiana, as more accurately described in the application.

Kathy Vannice, Ashton Land Surveyor appeared to represent the applicant. She stated that this was not storage units, but a storage building for the lawn equipment used by the Muncie Housing Authority. She stated that there being overhead electrical lines and a gas line on the property caused some issues with the planting requirements. She stated that they had a discussion with the attorney for the YWCA and they discussed the fence and it would be a vinyl 6’ tall privacy fence. She stated that a more secure site was needed for the equipment and that they would be coming to get the items and then bringing it back, so not a lot of additional traffic would be added.

Ms. Fritch asked if there was an option to explore plantings along Madison Street.

Ms. Vannice stated that they could not do anything full sized due to the overhead electrical lines.

Ms. Fritch asked if there was a landscape plan, just not meeting the greenbelt requirements.

Ms. Vannice stated that when the first started they planned to ask to not meet any of the corridor requirements, and that they did only have the shrubs for plantings.

Ms. Swackhamer stated that she would like to clarify that she stated residence zone, it was the BV Variety Business Zone.

Mr. Hinds asked if they planned to do anything about the building that was over the property line.
