Mr. Hanson stated that it was rare for students to have more than 1 vehicle and that there was street parking if they had visitors. He stated that he had emailed Mr. Leach, City Engineer and his response was that he didn’t like the parking, but that he would not argue with the way they had been able to park. He stated that he looked in the area, and there were many other dwellings with a similar parking layout. He stated that they had a backup plan to add a few parking spaces on the site if needed.
Ms. Swackhamer stated that the applicant had addressed the parking and that they would continue to work with the DMMPC office and Mr. Leach which they were all satisfied with. She stated that an email form Eric Brown with the Muncie Fire Department was received and that he had some questions and concerns if the basement was being used for living space.
Mr. Hanson stated that the basement bedrooms would be eliminated in the redevelopment of the structure. He stated that the mechanical room would be down there and that the tenants would not have access to that area.
Ms. Swackhamer stated that Mr. Brown stated that with 3 units it would be classified as a class 1 structure and need to comply with current fire codes and pass inspections.
Mr. Hanson stated that he could understand if all 3 units were in one structure.
Ms. Swackhamer stated that Mr. Hanson would need to clarify with Mr. Brown.
Ms. Fritch asked about the proposed changes to the structure and the altering of the physical character to the neighborhood.
Mr. Hanson stated that the house would change on the outside. He stated that they had been to this Board many times with similar requests and that their homes were very nice and that the changes will be for the better.
No one appeared in opposition.
Ms. Fritch made a motion to approve BZA 31-26 the appeal filed by B&B Premier Properties with the hardship as stated in the application with the following conditions; 1) That the applicant continues to work with the City Engineer and DMMPC staff to address parking needs and: 2) That the applicant obtains all necessary permits and approvals including the Muncie Fire Department and the City Building Commissioner. Mr. Billingotn seconded the motion. Voting in favor: Mr. Billington, Mr. Hamilton, Mr. Hinds, Mr. Ivy, Ms. Knapp, and Ms. Mathewson. Voting against: Ms. Fritch. Motion carried, BZA 31-26 approved (6-1).
