Whereas, the total fee for Construction Support Engineering Services is $120,666.01, which includes NV5’s fee of $100,681.46 and the subconsultant fee of $19,984.55 for Bright View Engineering for traffic signal support services; and

Whereas, the Chief Financial Officer of the Borough of Somerville has certified that funds are, or will be, available for this purpose; and

Whereas, NV5, Inc. has represented that it has not made any reportable contribution to a political or candidate committee of any candidate for or holder of a public office having ultimate responsibility for the award of this contract, in the one (1) year period prior to the award of this contract, as required by N.J.S.A. 19:44A-20.5; and

Whereas, the Borough Clerk has determined that the nature, timing, and circumstances of this engagement justify award of this contract without the fair and open competitive process;

Now, Therefore, Be It Resolved, by the Mayor and Borough Council of the Borough of Somerville, County of Somerset, State of New Jersey, that the Borough is hereby authorized to enter into a contract with NV5, Inc., 412 Mt. Kemble Avenue, Suite 100C, Morristown, New Jersey 07960, for Construction Support Engineering Services for the Safe Routes to School Project along Veterans Memorial Drive East, in an amount not to exceed $120,666.01, pursuant to the terms and conditions set forth in the Agreement dated in accordance herewith; and

Be It Further Resolved that the award of this contract is made without the “fair and open” process pursuant to N.J.S.A. 19:44A-20.5, and the Borough Clerk is hereby directed to post notice of this award on the Borough’s website as required by law; and

Be It Further Resolved that the Mayor and Borough Clerk are hereby authorized and directed to execute any and all documents and take such further action as may be necessary to effectuate the purposes of this Resolution; and

Be It Further Resolved that a copy of this Resolution shall be filed with the Borough Clerk and shall be available for public inspection.
