The Mayor and Borough Clerk are hereby further authorized and directed to execute the Landlord’s Release and Waiver Agreement by and between the Borough of Somerville and CenterNode Group LLC, in substantially the form at Exhibit C, together with such non-material revisions as may be approved by the Borough Attorney.
5.
Except as expressly provided in the Assignment and Assumption of Redevelopment Agreement, all terms and conditions of the Redevelopment Agreement shall remain unchanged and in full force and effect

This Resolution shall take effect immediately.

Amending the Borough of Somerville Policy and Procedure Manual to Adopt a Pregnancy and Maternity Leave Policy
Whereas, the Borough of Somerville (“Borough”) maintains a Policy and Procedure Manual governing the terms and conditions of employment for Borough employees, which is periodically reviewed and updated to reflect current law and best practice; and
Whereas, the Borough Personnel and Procedure Manual shall be amended to amend the Pregnancy and Maternity Leave policy to ensure compliance with the Pregnancy Discrimination Act, the Family and Medical Leave Act, the New Jersey Family Leave Act, the Fair Labor Standards Act, the Health Insurance Portability and Accountability Act, the Patient Protection and Affordable Care Act, and applicable Equal Employment Opportunity Commission.
Now, Therefore, Be It Resolved, by the Borough Council of the Borough of Somerville, County of Somerset, State of New Jersey, as follows:
1.The complete Pregnancy and Maternity Leave policy is hereby amended and adopted and incorporated into and made a part of the Borough of Somerville Policy and Procedure Manual.
2.The policy shall be effective immediately upon adoption of this Resolution and shall govern pregnancy and maternity leave matters for covered employees of the Somerville Police Department.
3.Any prior policy, procedure, or provision of the Policy and Procedure Manual in conflict with the attached policy is hereby superseded to the extent of such conflict.
4.The Borough Clerk is directed to file this Resolution and the attached policy as part of the official Policy and Procedure Manual and to distribute copies as appropriate.
