Now, Therefore, Be It Resolved, by the governing body of the Borough of Somerville that the Borough of Somerville wishes to participate in an electronic tax sale.

Be It Further Resolved, that Paige Elster, Tax Collector, shall and hereby is authorized to complete an Agreement for Services to participate in the electronic tax sale.

Approving the Release of the Maintenance Guarantee for Shantana, LLC, 132 North Gaston Avenue, Block 43, Lot 1.01, Application No. 2025007P, File No. 18182025007P in the amount of $6,110.17

Whereas, Shantana, LLC, owner of the property located at 132 North Gaston Avenue, identified on the municipal tax map as Block 43, Lot 1.01, received site plan approval under Application No. 2025007P, File No. 18182025007P; and

Whereas, a maintenance guarantee was posted in connection with the approved site improvements; and

Whereas, by correspondence dated June 30, 2026, Cole & Associates, LLC, the Municipal Engineer, reviewed the complete improvements and recommended the release of the maintenance guarantee; and

Whereas, Cole & Associates, LLC has determined that the required improvements have been satisfactorily completed and recommends that the maintenance guarantee be released in the amount of Six Thousand One Hundred Ten Dollars and Seventeen Cents ($6,110.17).

Be It Resolved, the Borough Council of the Borough of Somerville hereby approves the release of the maintenance guarantee for Shantana, LLC, 132 North Gaston Avenue, Block 43, Lot 1.01, application no. 2025007P, file no. 18182025007P in the amount of $6,110.17.

Authorizing the Execution of an Assignment and Assumption of Redevelopment Agreement with CS Energy/Hathaway Solar, LLC and CEP Renewables, LLC and Interim Escrow Agreement with CEP Renewables, LLC

Whereas, by Resolution No. 26-0316-120 adopted on March 16, 2026, the Borough Council approved the transfer of the redevelopment project located on Block 124, Portions of Lots 1, 17.01, 20, 21 and 22 within the Station and Landfill Redevelopment Area from CS Energy/Hathaway Solar, LLC to CEP Renewables, LLC, approved the assignment and assumption of the Redevelopment Agreement, and conditionally designated CEP Renewables, LLC as redeveloper, subject to execution of an Assignment and Assumption of Redevelopment Agreement; and
