Performers may accept voluntary contributions of money or property in any type of receptacle. No performer shall demand payment, verbally coerce, or condition passage or engagement upon a contribution; all contributions shall be voluntary.

Any merchandise offered by a performer in connection with a performance shall be offered on a voluntary-contribution basis only. The sale of merchandise or goods for a fixed price shall constitute peddling or vending and shall be subject to the licensing requirements of the Peddling and Soliciting Code.

If a performer is asked to leave a performance location by the owner or other person with authority over private property on which the performer is performing, or by any law enforcement officer or code enforcement officer of the Borough, the performer shall promptly cease the performance at that location and relocate accordingly to another location permitted under this chapter.

No person may perform inside a public building in the Borough.

No person may perform in a street unless such street has been closed to vehicular traffic by lawful authority, and in no event may any person perform on any street on which a Programming Event is being held.

No performer shall hinder or prevent the movement of persons on any public street, road, highway, sidewalk, or right-of-way, or to, from, within, or upon public or private property, so as to interfere with the rights of others.

No performer shall continue to perform in any public place which does not provide sufficient area to accommodate any group of persons observing the performance so as to allow the free passage of any person upon public property or to or from private property. Any performer shall not obstruct a pedestrian passageway, unobstructed pedestrian access shall be maintained on any sidewalk at all times.

No performer shall block or obstruct any building entrance or exit, fire hydrant, fire escape, driveway, crosswalk, bus stop, loading zone, handicapped parking space or access ramp, or outdoor dining area.

No performer shall use any knife, sword, axe, saw, torch, flame, or other dangerous instrument, or any animal, as part of a performance in a public place.

No performer shall erect any tent, stage, or similar structure in a public place, or connect to any Borough electrical outlet or utility without prior written authorization of the Borough Administrator or his or her designee.

No performance shall violate the borough’s noise regulations. No sound amplification shall be used.

No performer shall leave equipment unattended in a public place.
