Exterior Restoration Project, performed by Dell-Tech Inc. under contract dated December 10, 2024, is hereby accepted as complete as of the date of this resolution; and

Be it further resolved that Application and Certificate for Payment No. 7 is hereby approved and the Chief Financial Officer is authorized and directed to issue final payment to Dell-Tech Inc. in the amount of $12,446.30, together with the full release of all retainage in the amount of $3,435.00, no retainage being withheld, for a total disbursement of $15,881.30, upon receipt of the Architect's executed certification for payment; and

Be it further resolved that the two-year maintenance period under Maintenance Bond No. 7464745M shall run from the date of completion and acceptance of the Project through April 29, 2028, and the Borough hereby reserves all rights and remedies under said bond and under the contract with respect to any defects in materials or workmanship arising during the maintenance period; and

Be it further resolved that, upon issuance of the final payment and release of retainage authorized herein, the contract with Dell-Tech Inc. for the Project is hereby deemed closed and any remaining unexpended contract balance shall be released and returned to the appropriate account; and

Be it further resolved that the Mayor, Borough Clerk-Administrator, and Chief Financial Officer are hereby authorized to execute any documents necessary to effectuate the closeout of the Project; and

Be it further resolved that certified copies of this resolution be forwarded to Architect, Chief Financial Officer and Project Manager.

Authorizing the Purchase of Philips HeartStart FRx Defibrillators from V.E. Ralph & Son, Inc. for the total amount of $34,098.21

Whereas, the Borough of Somerville (the “Borough”) is a participating subdivision in the national opioid settlement agreements entered into by the State of New Jersey with opioid manufacturers, distributors, and related entities, and as such receives direct distributions of opioid settlement proceeds, which the Borough maintains in a dedicated Opioid Settlement Trust Fund; and

Whereas, pursuant to the terms of the settlement agreements includes support for first responders and the purchase of equipment used in responding to opioid overdoses and related medical emergencies; and
