§ 60-7. Enforcement; violations and penalties.
- A. This chapter shall be enforced by the Police Department and the Code Enforcement Officer of the Borough.
- B. Prior to the issuance of any summons for a violation of this chapter, the enforcing officer shall first advise the performer of the violation and provide the performer a reasonable opportunity to come into compliance by relocating, reducing volume, or otherwise correcting the condition.
- C. Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine of $500.00. Each day that a violation continues shall constitute a separate offense.
- D. No equipment of a performer shall be confiscated unless such equipment is causing damage or harm, constitutes evidence of an offense, or is abandoned.
Section 2. Severability.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
Section 3. Repealer.
All ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency.
Section 4. Codification.
This Ordinance shall be codified in the Code of the Borough of Somerville, and the codifier is authorized to assign appropriate chapter and section numbers and to make non-substantive editorial revisions consistent therewith.
Section 5. Effective Date.
This Ordinance shall take effect upon final passage and publication in accordance with law.
