Whereas, Station Road, Robeson Street, South Davenport Street and Sternadori Drive, located within the Somerville Station development, are to be dedicated to and accepted by the Borough of Somerville as public roadways; and

Whereas, each townhome located on the aforesaid streets is constructed with a garage available for the parking of a motor vehicle, and the Borough Council finds that the use of said garages for vehicle parking is necessary to preserve the supply of on-street parking; and

Whereas, the Borough Council desires to establish a residential permit parking system permitting one (1) on-street parking permit per townhome for a second vehicle, and to impose time limits upon all other vehicles parked upon said streets; and

Whereas, the Borough Council further finds that residents and tenants of the Avalon Bay development are provided with off-street parking within parking decks constructed for that purpose and shall not be eligible for residential parking permits under this section; and

Whereas, the Somerville Civic Center, located at 24 Robeson Street, hosts public meetings which often commence at 6:00 p.m. and 7:00 p.m. and may in some cases extend beyond two (2) hours, and a plaza located in front of the Somerville Civic Center provides parking to serve the Civic Center, Leasing Office and the adjacent train station, warranting the accommodations and regulations set forth herein;

Now, Therefore, Be It Ordained by the Borough Council of the Borough of Somerville, County of Somerset, State of New Jersey, as follows:

Section 1. Chapter 166 (Vehicles and Traffic) of the Code of the Borough of Somerville is hereby amended to add a new § 166-46.5, Schedule VE: Permit Parking and Time-Limit Parking Zone (Without Permit), to read in its entirety as follows:

§ 166-46.5. Schedule VE: Permit Parking and Time-Limit Parking Zone

A.
Applicability. This section shall apply to the streets or parts of streets set forth in the schedule contained in Subsection J below, upon their dedication to and acceptance by the Borough as public roadways.
B.
Townhome Garage parking required. Every townhome located on the streets identified in this section is constructed with a garage. Every owner or tenant of such a townhome shall use the garage for the parking of a sole motor vehicle. More than one motorcycle may be parked in the garage.
C.
Residential parking permits. Each townhome on the streets identified in this section maintaining a second motor vehicle shall, upon application in accordance with § 166-10.1, be issued one (1) residential parking permit authorizing the on-
