purposes of vehicular travel, by ordinance or resolution of the governing body of the municipality; and

Whereas, the Borough Council of the Borough of Somerville has determined that it is in the best interest of the Borough to establish, as a new Article XXI of Chapter 166 of the Code of the Borough of Somerville, a uniform definition of Title 39 and a uniform procedure for the designation of semi-public areas within the Borough upon which the provisions of Title 39 shall be enforced, and to enumerate within the Code each property so designated; and

Whereas, the Borough of Somerville Police Department has reviewed one or more applications submitted pursuant to N.J.S.A. 39:5A-1, together with the accompanying site plans and tax maps, and has recommended that the provisions of Title 39 be made applicable to the semi-public areas identified therein in order to permit the enforcement of vehicular traffic and parking regulations thereon; and

Whereas, the Borough Council of the Borough of Somerville has determined that the establishment of Article XXI and the enforcement of Title 39 upon designated semi-public areas will promote the public health, safety and welfare of the residents of the Borough and of the persons using such areas.

Now, therefore, be it ordained by the Borough Council of the Borough of Somerville, County of Somerset, State of New Jersey, as follows:

Section 1. The aforementioned recitals are incorporated herein as though fully set forth at length.

Section 2. Chapter 166, “Vehicles and Traffic,” of the Code of the Borough of Somerville is hereby amended and supplemented to add a new Article XXI, entitled “Title 39 Enforcement,” to read in its entirety as follows:
