Uniform Traffic Control Devices and the applicable provisions of Title 39, and shall be installed and maintained at the sole cost and expense of the owner.
B. The designation of a semi-public area under this article shall not constitute or be deemed an acceptance or dedication of any roadway, driveway or parking area as a public street, nor shall it impose upon the Borough any obligation for the construction, maintenance, repair, lighting, drainage, or snow and ice removal thereof.
§ 166-105. Designated properties.
The provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be enforced upon the following semi-public areas, each designation having been approved by the Borough Council. Approved applications:
A. Somerville Towne Center, 125–175 West Main Street (application of Somerville Urban Renewal Phase III, LLC, 444 Hoes Lane, Suite 200, Piscataway, New Jersey 08854, dated August 10, 2026), designated on the official Tax Map of the Borough of Somerville as Block 117, Lots 1.02, 1.03 and 1.04; Block 117.01, Lots 1.03 and 1.04; and Block 118, Lot 21.01, comprising:
- Block 117, Lot 1.02 — Somerville Urban Renewal Phase I, LLC (ShopRite);
- Block 117, Lot 1.03 — Somerville Urban Renewal Phase II, LLC (Building 2);
- Block 117, Lot 1.04 — Somerville Urban Renewal Phase II, LLC (Davenport Street);
- Block 117.01, Lot 1.03 — Somerville Urban Renewal Phase III, LLC (Building 1);
- Block 117.01, Lot 1.04 — Somerville Urban Renewal Phase IA, LLC (Bank);
- Block 118, Lot 21.01 — Somerville Towne Center Parking, LLC (South Street Lot).

Section 3.
Each application for the enforcement of Title 39 upon the semi-public areas enumerated in § 166-105 of the Code of the Borough of Somerville, as set forth in Section 2 hereof, is hereby approved by adoption of this ordinance.
Section 4.
The Borough Clerk is hereby directed to forward a certified copy of this ordinance, together with a copy of each application and site plan, to the Commissioner
