of the New Jersey Department of Transportation for approval pursuant to N.J.S.A. 39:5A-1, and this ordinance shall not take effect as to the enforcement of Title 39 upon any semi-public area enumerated in § 166-105 until such approval has been obtained.
Section 5. The Mayor, Borough Clerk and other appropriate Borough officials are hereby authorized to execute any documents necessary to effectuate Title 39 enforcement upon the semi-public areas enumerated in § 166-105 on behalf of the Borough of Somerville.
Section 6. The Borough Clerk, in consultation with the Borough’s codifier, is hereby authorized to renumber the sections of Article XXI as may be necessary to conform to the numbering scheme of the Code of the Borough of Somerville, provided that no such renumbering shall alter the substance of this ordinance.
Section 7. If any part of this ordinance shall be deemed invalid, such part shall be severed and the invalidity thereof shall not affect the remaining parts of this ordinance.
Section 8. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.
Section 9. This ordinance shall take effect upon final passage and publication in accordance with law, and, as to the enforcement of Title 39 upon any semi-public area enumerated in § 166-105, upon the approval of the Commissioner of Transportation as provided in Section 4 hereof.

Approving Chapter 159 from the National Opioids Settlement Trust
Whereas, N.J.S.A. 40A 4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and
Whereas, said Director may also approve the insertion of any item of appropriation for an equal amount; and
Whereas, the Borough of Somerville has received notice of an award of $1,462.24 from National Opioids Settlement Trust and wishes to amend its 2026 Budget to include this amount as revenue.
