§ 166-102. Definitions.

As used in this article, the following terms shall have the meanings indicated:

Commissioner — The Commissioner of the New Jersey Department of Transportation.

Owner — The owner or owners of record of a semi-public area, or the duly authorized agent thereof, including any lessee, operator, condominium or property owners’ association, or property management entity having authority over such area.

Semi-Public Area — Any semi-public road, street, driveway, terminal, parking lot or other area located upon privately owned property within the Borough which is open to or used by the public for purposes of vehicular travel, within the meaning of N.J.S.A. 39:5A-1.

Title 39 — Title 39 of the Revised Statutes of New Jersey, entitled “Motor Vehicles and Traffic Regulation,” N.J.S.A. 39:1-1 et seq., together with all amendments and supplements thereto and all regulations promulgated thereunder, and specifically the provisions of Subtitle 1 thereof governing the registration, equipment and operation of motor vehicles, the rules of the road, and the stopping, standing and parking of vehicles.

§ 166-103. Application; approval procedure.

  1. A. The owner of a semi-public area may apply in writing to the Borough of Somerville Police Department for the enforcement of Title 39 upon such area. The application shall identify the property by street address and by block and lot as shown on the official Tax Map of the Borough and shall be accompanied by a site plan depicting all roadways, driveways, parking areas and traffic control devices upon the property.
  2. B. The Borough Council may, by ordinance, approve an application and designate the semi-public area in § 166-105 of this article.
  3. C. The Borough Clerk shall forward a certified copy of the designating ordinance, together with a copy of the application and site plan, to the Commissioner, and the enforcement of Title 39 upon the designated area shall not commence until the approval of the Commissioner pursuant to N.J.S.A. 39:5A-1 has been obtained.

§ 166-104. Signage; obligations of owner.
