To assist performers and promote the purposes of this chapter, the following public places are designated as preferred street performance locations within the Borough:

1. (1) The Division Street Pedestrian Plaza, between Main Street and Veterans Memorial Drive East;
2. (2) The public sidewalks along Main Street within the Downtown Area, subject to pedestrian clearance requirements;
3. (3) The plaza and grounds appurtenant to Borough Hall, 25 West End Avenue;
4. (4) Giardina Walk / such other Borough-owned parks, plazas, and walkways;
5. (5) Such additional locations as may be designated from time to time by resolution of the Borough Council.

The Borough, in cooperation with the Downtown Somerville Alliance, Inc., may publish and maintain a map of preferred performance locations and a best-practices guide for performers. Such materials shall be advisory only, and nothing in this section shall be construed to prohibit performance in any public place otherwise permitted by this chapter.

Performers are prohibited on any block either in the street or sidewalk on which a Programming Event is being held, during the dates and times of such Programming Event. During the dates and times of a Programming Event, street performance elsewhere in the Borough may be restricted to such areas as may be designated by the Borough or the Downtown Somerville Alliance, Inc. Programming Events are those events and activities hosted by the Borough of Somerville or by the Downtown Somerville Alliance, Inc., as reflected in the event calendar published and maintained by the Downtown Somerville Alliance, Inc., which shall be kept on file with the Borough Clerk and made available to the public. Ans said event calendar may change from time to time due to rescheduling and new programming.

Performers are prohibited at events that are organized, coordinated and endorsed by the Borough of Somerville unless authorized as part of the event.

Nothing in this section shall prohibit a performance during a Programming Event where the performer has been engaged, scheduled, or expressly authorized by the event organizer, the Downtown Somerville Alliance, Inc., or the Borough as part of the programming for such event.
